MINUTES APRIL 14, 2004
Formal action may be taken at this meeting.
Chairman Artigliere called the meeting to order at 7:35 pm.
ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times” December 30, 2003. Notice was posted on the municipal bulletin board in the
Township Administration Building in the Washington Township, New Jersey, and notice was filed with the Township clerk on December 30, 2003.
ROLL CALL
Members Present: Mayor Horensky, Mr. Parillo, Mr. Dante, Mr. Sodtalbers, Mr. Iwaniszyn,
Mr. Artigliere, Ms. Pflugh, Mr. Rossi.
Members Absent: Mr. Klingel, Mr. Strunk, Mr. Rossi
COMMUNICATIONS: A correspondence list was provided at the meeting.
MINUTES: A motion to approve the minutes of March 31, 2004 as written was made by Mr. Parillo, seconded by Mayor Horensky, all ayes motion carried.
DISCUSSION ITEMS:
1. Ed Mark 31 - WTPB# 2003-11 - Resolution for a Minor Subdivision with a Variance application for block 65, Lot 8.02 & 8.03. The application was approved on March 10, 2004.
Members eligible to vote: Mr. Parillo, Mr. Klingel, Mr. Iwaniszyn, Mr. Artigliere, Ms. Pflugh
A motion to approve a resolution for a Minor Subdivision with a Vaiance application was made by Mr. Parillo, seconded by Ms. Pflugh, Vote: Parillo, Pflugh, Iwaniszyn, Artigliere -
Ayes, 0 - Nay, 0 - Abstain, motion carried.
2. Mr. & Mrs. M. Riotto - WTPB#2004-4 - Resolution for a “C” Variance, Block 67 Lot 62.01, The application was deemed complete on March 10, 2004. The application was
approved on March 31, 2004. Eligible to vote: Horensky, Parillo, Sodtalbers, Iwaniszyn, Strunk, Rossi, Artigliere, Pflugh. A motion to approve a resolution for a Variance application was made by Mr. Sodtalbers, seconded by Mayor
Horensky, Vote: Sodtalbers, Horensky, Parillo, Iwaniszyn, Artigliere, Pflugh - Ayes , 0 - Nay, 0 - Abstain, motion
carried.
3. Recreation Commission - WTPB#2004- 6 - Resolution for a “C” Variance for a public restroom for Block 18 Lot 13. The application was deemed complete
and approved on March 31, 2004. Eligible to vote: Horensky, Parillo, Sodtalbers, Iwaniszyn, Strunk, Rossi, Artigliere, Pflugh. A motion to approve a resolution for a Variance application was made by Mr. Iwaniszyn, seconded by Ms. Pflugh,
Vote: Iwaniszyn, Pflugh, Horensky, Parillo, Sodtalbers, Artigliere, - Ayes, 0 - Nay, 0 - Abstain, motion carried.
4. M. Spann - WTPB# 2003-21 - Continuation of Public Hearing for Block 82, Lot 17. The application was deemed complete on January 28, 2004. Eligible to vote: Parillo, Klingel,
Artigliere, Pflugh, Rossi. Mr. Ritter the applicant’s engineer gave the board a brief description of the 142 acre site which consists of farm fields, farm structures and barns and undeveloped land. The following exhibits were
presented: A-1 Aerial photo, A-2 Map of existing features,
A-3 Slopes, A-4 Conventional layout, A-5 Conventional layout with slope, A-6 Applicant’s proposal, A-7 Pollution analysis, A-8 Sheet 4 of 5 cluster plan.
Mr. Ritter stated 85 acres of land under the proposed application would remain open space.
Mr. Ritter explained impervious coverage, disturbance, preserved agriculture, public benefit for open space, and the family would continue farming. Planner, Ms. Doyle briefly
answered questions from the board concerning slope and wetlands. Mr. Max Spann Jr., described the families 25 years of farming which includes breeding heffers to sell. Mr. Spann Jr. stated the existing driveway from Asbury Anderson Rd.
would continued to be used for access. Mr. Max Spann Sr. was sworn in by Attorney S. Gruenberg and proceeded to answer questions from the board concerning the usage of the remaining land and how it would be maintained. Planner S. Doyle
stated the stream buffer on both sides would be 300ft., and lot 25 could possibly be unsuitable for building.
Public Comment:
Shaun Levin of 116 East Asbury Anderson Road.
Mr. Ritter addressed questions about the proposed location of a new road.
Break 9:10 - 9:20
Attorney S. Gruenberg swore in witness Matthew Mulhall of M2 Associates who is a licensed geologist in NJ and Pa. Mr. Mulhall addressed questions from Engineer J. Cilo Jr. concerning
the carbonate rock ordinance and would the ground be able to support homes, Mr. Mulhall stated the ground could support homes, however sink holes are still a possibility and the applicant must go through the process. Mr. Mulhall said
there must be a Phase I and Phase II investigation.
Engineer J. Cilo and the Mr. Mulhall briefly discussed the 25 wells which will have to meet state standards. Chairman Artigliere stated he had concerns about septic systems and wells
on lots smaller than four acres, and how could the plan be improved. The geologist then addressed questions regarding infiltration of water, on site recharge and differences between solution cavities and sinkholes.
Attorney Kobert concluded the testimony for the evening and announced he would like to resume the public hearing on April 28, 2004.
Planner S. Doyle briefed the board on the Highlands legislation.
