MINUTES AUGUST 31, 2005
The meeting will begin at 7:30 p.m.
Formal action may be taken at this meeting.
No new business will be heard after 11:00 p.m.
Chairwoman Pflugh called the meeting to order at 7:45 p.m.
ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the Municipal bulletin board in the Township
Administration building in Washington Township, New Jersey, and notice was filed with the Township Clerk on December 22, 2004.
ROLL CALL:
Members Present: Mr. Strunk, Mr. Sodtalbers, Mr. Klingel, Mr. Iwaniszyn, Ms. Pflugh, Ms. Pietrangelo, Mr. Birkner, Ms. Belz
Members Absent: Mayor Dempski, Mr. Howell, Mr. Rossi
Also Present: Attorney S. Gruenberg, Engineer J. Cilo Jr., Planner S. Doyle
CORRESPONDENCE: A correspondence list was submitted to the Land Use Board members.
MINUTES: A motion to approve the minutes from the August 10, 2005 meeting as written was made by Mr. Sodtalbers, seconded by Mr. Birkner, Vote: Sodtalbers, Birkner, Klingel,
Pflugh, Belz - Ayes, 0 - Nay, 0 - Abstain, motion carried.
RESOLUTIONS:
1. Trade Zone Auto - WTPB#2004 - 24 - Resolution for a Major Site Plan application with Variance relief for Block 79, Lot 7.06. This application was denied on March 30, 2005.
Eligible to Vote: Belz, Rossi, Howell, Sodtalbers, Iwaniszyn, Pietrangelo, Birkner
This resolution will be scheduled for the September 14, 2005 meeting.
2. McCullough Road - WTPB#2004-14 - Resolution for Preliminary Major Subdivision for Block 47, Lot 9. This application was approved on July 13, 2005.
Eligible to Vote: Dempski, Iwaniszyn, Sodtalbers, Klingel, Pflugh, Birkner
A motion to approve was made by Mr. Sodtalbers, seconded by Mr. Klingel,
Vote: Sodtalbers, Klingel, Iwaniszyn, Pflugh, Birkner - Ayes, 0 - Nay, 0 - Abstain, motion carried.
3. Tractor Supply Co. - WTPB#2005-19 - Resolution for a Site Plan application with Variance relief for Block 22, Lot 3.14, 3.15, 3.16. This application received approval
on July 27, 2005. Eligible to Vote: Sodtalbers, Rossi, Pflugh, Pietrangelo, Birkner
This resolution will be scheduled for the September 14, 2005 meeting.
4. C. Clark - WTPB#2005-24 - Resolution for a Variance application for Block 5, Lot 3. This application was approved on August 10, 2005. Eligible to Vote: Dempski, Howell,
Sodtalbers, Klingel, Rossi, Pflugh, Birkner, Belz. A motion to approve was made by Mr. Sodtalbers, seconded by Mr. Klingel, Vote: Sodtalbers, Klingel, Pflugh, Birkner, Belz - Ayes, 0 - Nay, 0 - Abstain, motion carried.
COMPLETENESS:
1. Bay Storage - WTPB#2005-11 - Second Completeness review for a Preliminary Major Site Plan for Block 40, Lot 14.01. This application was deemed incomplete on April 13, 2005.
A motion to deem the application complete was made by Mr. Strunk seconded by Mr. Sodtalbers, Vote:, Strunk, Sodtalbers, Pflugh, Iwaniszyn, Klingel, Pietrangelo, Birkner, Belz - Ayes, 0 - Nay, 0 - Abstain, motion carried. The public hearing
for this application is scheduled for September 28, 2005.
PUBLIC HEARING AND DISCUSSION ITEMS:
1. Heron Run - WTPB#2005-1 - Continuation of a Public Hearing for a Preliminary Major Subdivision for Block 82, Lot 17, continued from July 27, 2005.
Eligible to Vote: Dempski, Strunk, Pflugh, Rossi, Pietrangelo, Iwaniszyn, Sodtalbers
Board member Mr. Birkner left the meeting at this time. Attorney J. Kobert and Engineer
D. Plante represented the applicant. Mr. Kobert stated he had received the letter dated August 30, 2005 from Engineer J. Cilo and Planner S. Doyle.
Planner S. Doyle requested all of the homes on the Lebanon Township side of the river be shown on the map, the Board agreed that would not be necessary. The applicant agreed to
locate all natural features within 200'of the site in Washington Township.
Mr. Strunk requested all drainage structures be shown on the map.
Mr. Sodtalbers asked if there were any structures on the tank farm that would have an effect. The applicant agreed to have a limestone expert address the effect of the tank farm
plume on Lot 17.17. Attorney S. Gruenberg swore in Mr. Matthew Mulhall of M2 Associates Inc. Mr. Mulhall submitted exhibit A-16 and A-11 Road Section and A-12. Mr. Strunk expressed concerns for the depth of the drainage pipe and swale.
The applicant agreed to review the design of the swales adjacent to Heron Run with the Board Engineer and the Site Engineer. Mr. Strunk stated in the wintertime someone could slide off their driveway.
Mr. Mulhall reviewed and discussed the detention basins, Mr. Cilo suggested the basins be lined with neoprene to help prevent sinkholes. The applicant agreed for a sinking fund to be
developed. Engineer J. Cilo requested an as built location of all borings test pits and existing sink holes so the location is documented. The applicant agreed for the infiltration basin to be flooded with 1000 to 2000 gallons of water
to determine if there are any sink holes, Mr. Plante will provide information on how fast the basins drain. Engineer J. Cilo suggested a geotechnical report be filed with the Board, the applicant agreed. The Board agreed to a wider
entrance of 36' for the first 150' entering the subdivision instead of a concrete pad for school children. Planner S. Doyle stated a pre-funded Homeowner’s Association should be filed with the County at a cost of $200.00 per lot required to
maintain detention facilities. Ms. Doyle stated the applicant should provide a manual for the cleaning of the basins after a storm. Ms. Pietrangelo asked if the top soil would remain on site, Mr. Mulhall stated that it would.
PUBLIC COMMENT: None at this time.
This public hearing for this application will resume on October 12, 2005 without further notice being required.
2. Blue Mt.- WTPB#2004-20 - Continuation of a Public Hearing for a Minor Subdivision application with Variance relief for Block 24, Lots 6, 6.01 & 6.02. Due to the lengthy period
of time involved and the failure of the applicant to appear the Board found that the applicant had failed to prosecute the matter. A motion to dismiss the application for lack of prosecution was made by Mr. Sodtalbers, seconded by Ms.
Pietrangelo, Vote: Sodtalbers, Pietrangelo, Strunk, Klingel, Iwaniszyn, Pflugh, Belz - Ayes, 0 - Nay, 0 - Abstain, motion carried. A letter will be sent to the applicant and their attorney by Board Attorney S. Gruenberg informing them
of the Board’s decision.
ADJOURNMENT: 9:45 p.m.
With no further business before the Board and no public comment offered the meeting was adjourned.
