Chairwoman D. Pietrangelo called the meeting to order at 7:30 p.m.

ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the municipal bulletin board in the township administration building in Washington Township, New Jersey and notice was filed with the Township clerk on December 23, 2005.

ROLL CALL:

Members Present: Mayor Dempski, Mr. Strunk, Mr. Iwaniszyn, Ms. Pietrangelo, Mr. Sodtalbers, Mr. Zaret, Ms. Pflugh, Mr. Klingel

Members Absent: Mr. Howell, Ms. Belz, Mr. Rossi

Also Present: Attorney S. Gruenberg, Engineer W. Gleba, Planner S. Doyle

CORRESPONDENCE:  A list was provided to the land use board members.

MINUTES: Minutes from October 25, 2006, November 8, 2006 and November 29, 2006 meetings. A motion to approve the minutes as written from the October 25, 2006 meeting was made by Mr. Iwaniszyn, seconded by Mayor Dempski, Vote: Iwaniszyn, Dempski, Strunk, Klingel, Pflugh, Pietrangelo, Zaret - Ayes, 0 - Nay, 0 - Abstain, motion carried.

A motion to approve the minutes as written from the November 8, 2006 meeting was made by Mr. Sodtalbers, seconded by Mr. Zaret, Vote: Sodtalbers, Zaret, Dempski, Strunk, Klingel,Pflugh, Pietrangelo - Ayes, 0 - Nay, 0 - Abstain, motion carried.

A motion to approve the minutes as written from the November 29, 2006 meeting was made by Mr. Sodtalbers, seconded by Mr. Strunk, Vote: Sodtalbers, Strunk, Pietrangelo - Ayes, 0 - Nay, 0 - Abstain, motion carried.

COMPLETENESS:

1. J. Hackett - WTPB#2004-26 - Completeness review for a variance application for Block 43, Lot 23 located at 8 Morris Canal Trail. The applicant represented himself for completeness. Planner S. Doyle addressed completeness items per her review dated December 13, 2006. Ms. Doyle recommended the board deem the application incomplete the applicant did not meet the “D” variance checklist standards.

Attorney S. Gruenberg addressed the use variance issue. The applicant agreed to file the proper check lists. A motion to deem the application incomplete per planner S. Doyle’s review letter dated December 13,2006 was made by Mr. Sodtalbers, seconded by Mr. Iwaniszyn. Vote: Sodtalbers, Iwaniszyn, Klingel, Pflugh, Pietrangelo, Zaret - Ayes, 0 - Nay, 0 - Abstain, motion carried. Mayor Dempski and Mr. Strunk stepped down for this application. 

DISCUSSION & PUBLIC HEARING ITEMS: No public hearing items were presented at this time.

RESOLUTIONS:

1. Regency at Hawk Pointe/Asbury Farms - WTPB#2006-2 - Resolution for a Preliminary Major Subdivision and Site Plan application with Variance relief, approval granted on October 11, 2006 for Block 65 Lots 2 & 4 Block 65.02 Lot 1 located on Route 31 South.

Eligible to Vote: Howell, Sodtalbers, Klingel, Iwaniszyn, Pietrangelo

The board has requested the applicant be present at the December 20, 2006 meeting to clarify items for the resolution prior to approval.

2. Martron LLC - WTPB# 2006-12 - Resolution for a Final Site Plan application for Block 64, Lot 11 located at 283 Route 31 South. Approval granted on October 25, 2006.

Eligible to Vote: Strunk, Iwaniszyn, Dempski, Sodtalbers, Klingel, Pietrangelo, Zaret

A motion to approve was made by Mr. Sodtalbers, seconded by Mr. Klingel, Vote: Sodtalbers, Klingel, Iwaniszyn, Pietrangelo - Ayes, 0 - Nay, 0 - Abstain, motion carried.

3. Unity Bank - WTPB#2006-3 - Resolution for a Preliminary Major Site Plan application with Variance relief for Block 78 Lot 9 located at 5 East Asbury Anderson Road. Approval granted on October 25, 2006.Eligible to Vote: Strunk, Dempski, Klingel

This resolution has been rescheduled to the December 20, 2006 meeting.

4. Dale Coleman - WTPB#2005-25 - Resolution for a conditional use with bulk variance relief, approval granted on October 11, 2006 for Block 46 Lot 2 located at 138 Railroad Avenue. Eligible to Vote: Sodtalbers, Iwaniszyn, Rossi, Belz

This resolution has been rescheduled to the December 20, 2006 meeting.

5. Planner S. Doyle addressed items for the 2007 masterplan re-examination.

PUBLIC COMMENT:

Mr. F. Cregan of 62 Merlin Drive.
Mr. Cregan addressed his concerns regarding testimony for the Hawk Pointe boulevard traffic light timetable. The board will address this with the applicant.

EXECUTIVE SESSION: 9:20 - 9:28 p.m.

A motion was made to go into executive session to discuss pending litigation by Mr. Sodtalbers, seconded by Mr. Zaret all ayes motion carried. A motion was made to return to regular session by Mr. Strunk, seconded by Mr. Iwaniszyn, all ayes motion carried.

ADJOURNMENT: 9:30 p.m.
