MINUTES
FEBRUARY 28, 2007
Chairwoman K. Pflugh called the meeting to order at 7:35 p.m.
ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.”
Notice was posted on the municipal bulletin board in the township administration building in Washington Township, New Jersey and notice was filed with the Township clerk.
ROLL CALL: Members Present: Mayor Horensky, Mr. Howell, Mr.
Artigliere, Mr. Klingel, Mr. Iwaniszyn, Ms. Pflugh, Mr. Bundschuh, Mr. Elbassiouny (7:45) Members Absent: Mr. Zaret, Mr. Vergos, Mr. Rossi Also Present: Attorney S. Gruenberg, Engineer W. Gleba, Planner S. Doyle
CORRESPONDENCE: A list was provided to the land use board members.
MINUTES: Minutes from the January 31, 2007 meeting. A motion to approve the minutes as written was made by Mr. Howell, seconded by Mayor Horensky, Vote: Howell,
Klingel, Horensky, Pflugh, Bundschuh - Ayes, 0 - Nay, 0 - Abstain, motion carried.
ITEMS FOR COMPLETENESS: 1.
Jeff Hackett - WTPB#2004-26 - Completeness review for a Variance application for Block 43 Lot 23 located at 8 Morris Canal Trail. No action was taken at this time, the applicant did not appear.

Joe Justo - WTPB#2005-33 - Second completeness review for a Preliminary Major Subdivision application for block 74 Lot 5 located at 81 West Asbury Anderson Rd. The applicant has requested an extension to the March 14, 2007 meeting.
DISCUSSION ITEMS: 1. The Village Shoppes at Hawk Pointe - WTPB#2006-14 - Public hearing for a Preliminary Major Site Plan application for Block 65 & 65.02 Lots 2,4 & 1 located at 294 Route 31 South. Board member L. Artigliere
stepped down for the application. Attorney S. Gruenberg stated the board has jurisdiction to proceed. The applicant was represented by Attorney L. Tubman who briefly reviewed the waivers and variances requested for the
application. Ms. Tubman stated the applicant would return to address signage for the application. Mr. Gruenberg explained the notice and jurisdiction. Ms. Tubman introduced her witnesses, Attorney S. Gruenberg swore in the witnesses
Engineer E. Back, Traffic Engineer G. Dean, Architect E. Pavese, Landscape Architect C. Bentancourt. Mr. Back presented exhibit A-1 overall site plan, copy of sheet #3 colored rendering. Mr. Back reviewed the current application for the
shop rite supermarket and the general location. Mr. Back reviewed the utilities extended into the site, access driveways, parking facilities. Mr. Back stated with the construction of the supermarket the applicant is proposing to construct
437, 10 x 18 parking stalls 28 less based on the ordinance requirements. Mr. Back explained how the warehouse space increases the requirements for additional parking due to the additional square footage. Mr. Back reviewed the wet
water quality basins, state regulations, DEP and local stormwater management regulations, Mr. Back stated he would be making adjustments to the basin design per Engineer W. Gleba’s review letter dated February 23, 2007exhibit B-1. Mr. Back
reviewed the stormwater flow design as it exits the property and the changing water quality requirements by DEP and meeting the requirements. Mr. Back stated now the DEP does not allow him to tie into the current system and that is why the
design has been presented for the wet water quality basins. Mr. Back reviewed the reasons for the request for a waiver from the strict stormwater requirements. Mr. Back reviewed the revisions since he was in front of the board including the
access points from Rt. 31. signage for truck deliveries and residential areas. Mr. Back stated he would lower the fence to three feet to eliminate the need for a variance or design waiver. Mr. Back stated there would be a total of
six construction trailers on the site which would require a variance, five are a temporary situation and would be removed prior to a CO being issued. Mr. Back stated the trailers would be located on a gravel pad at the proposed
restaurant location.

Mark Kendra - WTPB#2007-01 - WTPB#2007-01 - Second completeness review and request for public hearing for Block 40 Lot 109 located on Jackson Valley Road. Attorney S. Gruenberg requested the board act on completeness, open up the meeting
and adjourn it to the March 28, 2007 meeting. Engineer W. Gleba briefly reviewed the status of the application for the board and recommended the application be deemed complete, the applicant will supply the requested items from Mr.
Gleba’s review letter. A motion was made by Mr. Iwaniszyn, seconded by Mr. Bundschuh to deem the application complete. Vote: Iwaniszyn, Bundschuh, Horensky, Howell, Elbassiouny, Klingel, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried.
Attorney S. Gruenberg stated the board had jurisdiction to begin the public hearing, but the applicant has requested the public hearing be adjourned to the March 28, 2007 meeting without further notice being required. Mr. Gruenberg
advised the public the public hearing for this matter would be adjourned to March 28, 2007 meeting without further notice being required. Village Shoppes at Hawk Pointe continued:
Chairwoman K. Pflugh asked Engineer W. Gleba to address water quality. Mr. Gleba stated the applicant is proposing to manage the water quality component by the use of two wet ponds. Mr. Gleba stated the purpose the ponds would be to
collect stormwater drainage. Mr. Gleba stated Mr. Back would provide an overview and testimony on the existing and proposed stormwater management systems of the site. Mr. Gleba recommended the grading for the back of the ponds be adjusted
to allow for more water to get to the basin. Mr. Gleba asked Mr. Back if there would be a water transfer issue from one location to another, Ms. Pflugh stated she would be interested what the impact or rules are from taking the water from
location to another. Mr. Gleba stated there would have to be some sort of a float system in the ponds. Mr. Back reviewed how the systems impacts the golf course. Mr. Elbassiouny asked how the water would be used for the site, Mr. Back
explained.
Planner S. Doyle addressed items from her February 6, 2007 letter exhibit B-2. Ms. Doyle asked for additional information be included on the plans for future use.
Ms. Tubman agreed to provide a chart to the resolution to include Ms. Doyle’s request. Ms. Doyle briefly addressed specifics for plans and resolutions.
Mr. Back stated he would review the feedback from Mr. Gleba and Ms. Doyle regarding the fencing. Mr. Gleba asked for the site distance lines at the sewerage plant what height of fence are we looking at there, Mr. Back stated he would take
another look at and maybe change. Mr. Back stated he believed the fence was a chain link fence he would make sure the fence would not exceed three feet in height.
Mr. Back addressed the parking requirements for the site including handicapped parking. PUBLIC COMMENT: No public comment offered. Architect Mr. E. Pavese was excepted as an expert witness. Mr. Pavese reviewed exhibits A-3, A-4, A-5,
A-6 showing the exterior and interior of the proposed Shop Rite. Mr. Pavese stated the proposed store would be state of the art and would have approximately 175 employees, hours of operation would be Monday through Saturday 7:00 a.m. to11:00
p.m., Sunday 7:00 a.m. to 9:00 p.m. Mr. Pavese reviewed the storage cart location, loading dock, retaining wall and building exterior. Mr. Elbassiouny requested additional information regarding the facade facing Route 31, adding more
dimension or possibly an awning on the Route 31 side. PUBLIC COMMENT: Ms. Julie Morringelo of 3 Primose Lane Ms. Morringelo asked Mr. Pavese to show the cart location in relationship to the handicapped parking. Mr. Bentancourt
Certified Landscape Architect reviewed the proposed landscaping of the lots including perimeter shade trees, plantings along basin, maintenance of plant height and a greater supplement of plantings. Ms. Tubman concluded the testimony at
this time, Attorney S. Gruenberg announced the application has been extended through March 28, 2007 with no further notice being required.

Mr. Artigliere returned to the board at this time. 3.
Le Dinner Factory - WTPB#2007-02 - Zoning appeal for Block 48 Lot 12 located at 218 Route 31 South. The applicants was represented by Attorney K. Benbrook. Mr. Benbrook briefly reviewed the application for the board. Mr. Benbrook stated
the building falls into the HC zone and was previously built to meet Washington Township specifications. Mr. Benbrook stated there would be no changes in the building structure and the building and parking will be used as is. Mr. Benbrook
stated the zoning officer had approved the use and we feel the building falls under code 64-2 for site plan exemption and the owners have been issued permits for renovations. Attorney S. Gruenberg swore in applicant Ms. Virginia Cunningham
of Pacesetter Drive. Ms. Cunningham briefly described the proposed meal preparation business. Ms. Cunningham stated the applicant would order their meal on line, a maximum of eight customers at one time, they would assemble their dinners
and take them home, the applicant will do the meal preparations for the customers. Ms. Cunningham stated there would be one or two part time employees for preparation work. Ms. Cunningham stated there would be no exterior improvements,
the inside will be sheet rocked, cleaned up and divided down the center. Ms. Cunningham stated there would be a seating area and eight work stations and would include a commercial kitchen in the rear with venting.
A motion to approve was made by Mr. Artigliere, seconded by Mr. Iwaniszyn, Vote: Artigliere, Iwaniszyn, Horensky, Howell, Elbassiouny, Klingel, Pflugh, Bundschuh - Ayes, 0 - Nay, 0 - Abstain, motion carried.

David English - WTPB#2007-03 - Public hearing for a variance application for Block 87 Lot 2 located at 1150 Butler’s Park Road. Attorney S. Gruenberg stated after reviewing the applicant’s advertising the board had jurisdiction to proceed.
The applicant represented himself and was sworn in by Attorney S. Gruenberg. The applicant stated the proposed addition to the home would be over the existing foot print of the home and there would be no additional bedrooms.
Attorney S. Gruenberg stated the second floor addition would be expanding a non conforming structure. Mr. English stated there would be no grade changes to the property. Mr. English stated he would be fixing up a home that is in need of
repair and would improve the area. Mr. English stated the property also has a new septic. Attorney S. Gruenberg asked Mr. English if the neighbors had any objections, Ms. Rodriquez of 1151 Butler’s Park came forward, Attorney S.
Gruenberg swore in Ms. Rodriquez. Ms. Rodriquez stated she lived across the street and any improvements would make the home more pleasing. A motion to approve was made by Mr. Klingel, seconded by Mr. Bundschuh, Vote: Klingel, Bundschuh,
Horensky, Howell, Elbassiouny, Artigliere, Iwaniszyn, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried.
PUBLIC COMMENT: No public comment offered.
EXECUTIVE SESSION: 10:35 p.m. - 10:50 p.m. A motion to go into executive
session to discuss personnel issues was made by Mr. Klingel, seconded by Mr. Artigliere. A motion to return to regular session was made by Mr. Artigliere, seconded by Mr. Klingel, all ayes motion carried. A motion was made by Mr.
Artigliere seconded by Mr. Klingel to change the status of the land use secretary’s salary from hourly to salary, Vote: Artigliere, Klingel, Horensky, Howell, Elbassiouny, Iwaniszyn, Pflugh, Bundschuh - Ayes, 0 - Nay, 0 - Abstain, motion
carried. A recommendation would be made to the Township Committee.
ADJOURNMENT: 10:50 p.m. With no further business before the board and no public comment offered the meeting was adjourned.
