MINUTES
FEBRUARY 9, 2005

The meeting will begin at 7:30 p.m.

Formal action may be taken at this meeting.

Chairman Kerry Pflugh called the meeting to order at 7:30 p.m. 

ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times”. Notice was posted on the Municipal bulletin board in the Township Administration Building in Washington Township, New Jersey, and notice was filed with the Township Clerk on December 22, 2004.

ROLL CALL:

Members Present: Mayor Dempski, Mr. Howell, Mr. Iwaniszyn, Ms. Pflugh, Mr. Klingel, Mr. Rossi, Ms. Pietrangelo, Mr. Sodtalbers, Alt.#1 Mr. Birkner, Alt. #2 Ms. Belz

Members Absent: Mr. Strunk

Also Present: Attorney S. Gruenberg, Planner S. Doyle

MINUTES: A motion to approve the minutes from the January 26, 2005 meeting as written was made by Mr. Iwaniszyn, seconded by Ms. Pietrangelo, Vote: Iwaniszyn, Pietrangelo, Howell, Sodtalbers, Klingel, Pflugh, Birkner, Belz - Ayes, 0 - Nay, Dempski, Rossi - Abstained, motion carried.

COMPLETENESS:

1.  R. Woolf - WTPB#2005-3 - Completeness for a Minor Subdivision application for Block 27, Lot 14. Board member Ms. Pietrangelo recused herself for this application.

The applicant was represented by Attorney Thomas Stover and Engineer Nevitt Duveneck. Mr. Duveneck reviewed the newly submitted plan per the Planner’s letter dated January 18, 2005. Mr. Duveneck addressed all items, Ms. Doyle recommended the application could be deemed complete at this time. A motion was made to deem the application complete by Mr. Sodtalbers, seconded by Mr. Iwaniszyn, Vote: Sodtalbers, Iwaniszyn, Dempski, Howell, Klingel, Rossi, Pflugh, Mr. Birkner - Ayes, 0 - Nay, 0 - Abstain, motion carried. This application is scheduled for public hearing on March 9, 2005.

2.  Dr. Zipf - WTPB#2004-32 - Completeness for a Variance application for Block 48, Lot 7.06. Deemed incomplete on December 8, 2004. Rescheduled from January 12, 2005.

Board members Ms Pietrangelo and Mr. Rossi recused themselves for this application.

The applicant Dr. Zipf, briefly explained to the board the location of the pool related to the Gazebo. Dr. Zipf stated the pool was too close to the gazebo. Planner S. Doyle reviewed Engineer John Cilo’s letter dated December 3, 2005 and suggested the applicant supply all requested measurements by the public hearing. Mayor Dempski stated he felt the application could still move forward and be deemed complete. Attorney S. Gruenberg explained public notice to the applicant and stated he would be glad to review a  draft notice for the applicant. A motion to deem the application complete with waivers granted was made by Mr. Iwaniszyn, seconded by Mr. Klingel, Vote: Iwaniszyn, Klingel, Dempski, Howell, Sodtalbers, Pflugh, Birkner, Belz - Ayes, 0 - Nay, 0 - Abstain, motion carried. This application is scheduled for public hearing on March 9, 2005.

RESOLUTIONS:

1. Hawk Pointe/Asbury Farms - WTPB#2004-8 - Resolution for a GDP amendment and Variance application for Block 65, Lot 65.02 and Lots 2, 4, &1. Approval granted on December 15, 2004. Eligible to Vote: Klingel, Sodtalbers, Pflugh, Iwaniszyn, Rossi

This resolution has been rescheduled for the February 23, 2005 meeting.

2.  Washington Driving Range - WTPB#2004-13 - An amendment to a resolution approved on October 27, 2004 for Block 66, Lot 20.07. Eligible to Vote: Klingel, Pflugh, Sodtalbers. A motion to approve was made by Mr. Sodtalbers, seconded by Mr. Klingel, Vote: Sodtalbers, Klingel, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried.

3. M. Hamas - WTPB#2004-31 - Resolution for a Variance application for Block 27, Lot 15.06. Approval was granted on January 12, 2005. Eligible to Vote: Sodtalbers, Rossi, Klingel, Iwaniszyn, Birkner. A motion to approve was made by Mr. Klingel, seconded by Mr. Iwaniszyn, Vote: Klingel, Iwaniszyn, Birkner - Ayes, 0 - Nay, 0 - Abstain, motion carried.

PUBLIC HEARINGS & DISCUSSION ITEMS:

1.  F. Phelps - WTPB#2004 - 35 - Public hearing for a Variance application for Block 60, Lot 5. The Board did not have jurisdiction to proceed on this application. Attorney S. Gruenberg stated the applicant will be required to re-notice for March 30, 2005.

2.  Washington Valley Estates - WTPB#2004-33 - Public hearing for a Preliminary Major Subdivision for Block 28, Lot 5. This application was deemed complete for Preliminary on December 15, 2004. This application was deemed incomplete for Final on December 15, 2004.

This application has been rescheduled from January 26, 2005 without further notice being required. This application was rescheduled to February 23, 2005 without further notice being required.

PUBLIC COMMENT: None at this time.

EXECUTIVE SESSION: 8:15 - 8:25 p.m.

A motion was made to go into executive session to discuss “Pending Litigation” by Mr. Rossi, seconded by Ms. Pietrangelo, all ayes motion carried. A motion was made by Mr. Klingel, seconded by Mr. Rossi to return to regular session, all ayes motion carried.

The Board had a brief discussion on a proposed future development for Washington Borough and Township and the Superfund Site.

ADJOURNMENT: 8:35 p.m.

With no further business before the board, and no public comment offered the meeting was adjourned.
