Chairwoman K. Pflugh called the meeting to order at 7:30 p.m.

ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the municipal bulletin board in the township administration building in Washington Township, New Jersey and notice was filed with the Township clerk.

Attorney S. Gruenberg swore in new Class IV member Leonard Artigliere.

ROLL CALL:
Members Present: Mayor Horensky, Mr. Howell, Mr. Elbassiouny, Mr. Artigliere, Mr. Klingel, Mr. Rossi, Mr. Iwaniszyn, Ms. Pflugh, Mr. Vergos

Members Absent: Mr. Bundschuh, Mr. Zaret

Also Present: Attorney S. Gruenberg, Engineer W. Gleba, Planner S. Doyle

CORRESPONDENCE: A list was provided to the board members.

MINUTES: Minutes from the December 20, 2006 meeting and January 3, 2007 reorganization meeting.
A motion to approve the December 20, 2006 minutes as written was made by Mr. Klingel, seconded by Mr. Iwaniszyn, Vote: Klingel, Iwaniszyn, Pflugh - Ayes, 0 - Nay, Rossi - Abstain, motion carried.

A motion to approve the January 3, 2007 minutes as written was made by Mayor Horensky, seconded by Mr. Rossi, Vote: Horensky, Rossi, Elbassiouny, Iwaniszyn, Howell, Pflugh, Klingel, Vergos - Ayes, 0 - Nay, 0 - Abstain, motion carried.

RESOLUTIONS:
1. Jerry O’Brien - WTPB#2006-7 - Resolution for an interpretation for Block 15 Lot 11 located at 482 Route 57 West, approval was granted on October 25, 2006.
Eligible to Vote: Pflugh, Iwaniszyn, Klingel. A motion to approve the resolution with changes was made by Mr. Klingel, seconded by Mr. Iwaniszyn, Vote: Klingel, Iwaniszyn, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried.

DISCUSSION & PUBLIC HEARING ITEMS:
1. The Village Shoppes at Hawk Pointe - WTPB#2006-14 - Completeness determination and Public hearing for a Preliminary Major Site Plan application for Block 65 & 65.02 Lots 2, 4 & 1 located at 294 Route 31 South. Mr. Artigliere and Mr. Rossi stepped down for the application and left the meeting at 8:10 p.m. The applicant was represented by Attorney L. Tubman. Ms. Tubman addressed the escrow deposits,

Ms. Tubman stated the applicant had posted an additional 10k and would keep the account solvent. Mr. Cotton stated he was in the process of getting a cash bond release squared away from the Township Engineer which would be deposited into the new account prior to the next meeting. Attorney S. Gruenberg stated the township engineer is the one who would authorize the release of a bond.

Mr. Gruenberg stated the board had jurisdiction to proceed

Ms. Tubman presented her witnesses for testimony. Attorney S. Gruenberg swore in the witnesses.

Engineer W. Gleba addressed his review letter dated January 8, 2007.

Engineer E. Back began his review of page 3 of the plans, Mr. Back stated the proposed building would be 69,623 sq. ft. Attorney S. Gruenberg raised issue with the 69,623 sq. ft. mentioned by Mr. Back versus the 65,000 noted in the legal ad. Mr. Gruenberg stated the board did not have jurisdiction to proceed with the public hearing and the applicant would have to re-notice with the exact size of the proposed building.

Attorney L. Tubman agreed, the applicant will return on February 14, 2007.

2. Chairwoman K. Pflugh briefly addressed the Highlands planning area changes.
Planner S. Doyle attended a highlands regional meeting and suggested the board consider requesting a Washington Township highlands workshop meeting be held to see how the highlands regulations will impact future development in the township.

PUBLIC COMMENT: No public comment was offered.

EXECUTIVE SESSION: 8:40 - 8:50 p.m.
A motion was made by Mr. Klingel, seconded by Mayor Horensky to go into Executive Session to discuss “Pending Litigation” all ayes motion carried.
A motion to return to regular session was made by Mr. Klingel, seconded by Mr. Iwaniszyn, all ayes motion carried.

ADJOURNMENT: 9:00 p.m.
With no further business before the board and no public comment offered the meeting was adjourned.
