MINUTES Vice Chairman R. Klingel called the meeting to order at 7:35p.m. ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times”. Notice was posted on the Municipal bulletin board in the Township Administration Building in Washington Township, New Jersey, and notice was filed with the Township Clerk on December 22, 2004. ROLL CALL: Members Present: Mayor Dempski, Mr. Sodtalbers, Mr. Klingel, Mr. Rossi, Mr. Iwaniszyn, Ms. Pietrangelo, Mr. Birkner Members Absent: Mr. Howell, Mr. Strunk, Ms. Belz Also Present: Attorney S. Gruenberg, Engineer J. Cilo Jr. MINUTES: A motion to approve the minutes from the December 8, 2004 meeting as written was made by Mr. Sodtalbers, seconded by Mr. Iwaniszyn, Vote: Sodtalbers, Iwaniszyn, Klingel, Rossi - Ayes, 0 - Nay, Mayor Dempski, Ms. Pietrangelo, Mr. Birkner - Abstain, motion carried. COMPLETENESS: 1. Dr. Zipf - WTPB#2004-32 - Completeness for a Variance application for Block 48, Lot 7.06. Deemed incomplete on December 8, 2004. This application has been rescheduled for the February 9, 2005 meeting at the request of the applicant. 2. Mr. F. Phelps - WTPB#2004-35 - Completeness for a Variance application for Block 60, Lot 5. A motion to approve with waivers granted for completeness was made by Mr. Rossi, seconded by Ms. Pietrangelo, Vote: Rossi, Pietrangelo, Dempski, Sodtalbers, Klingel, Birkner - Ayes, 0 - Nay, 0 - Abstain, motion carried. A public hearing for this application is scheduled for February 9, 2005. RESOLUTIONS: 1. McCullough Road II - WTPB#2004-28 - Resolution for a Minor Subdivision approval for Block 47, Lot 9. Approval granted on October 13, 2004. A motion to approve was made by Mr. Iwaniszyn, seconded by Mr. Rossi, 2. C. Donaldson - WTPB#2004-2 - Resolution for a Minor Subdivision application approved on December 8, 2004 for Block 74, Lot 6. This resolution has been rescheduled for the January 26, 2005 meeting. DISCUSSION ITEMS: 1. Blackman/Cole - Old file#93-3 - Request for the re-recording of Subdivision deeds for Block 27, Lot 13.04. This application has been withdrawn by Attorney A. Lowcher. 2. M. Hamas - WTPB#2004-31 - Public Hearing for a Variance application for Block 27, Lot 15.06 continued from November 17, 2004. No testimony was given at November 17, 2004,the Board did not have jurisdiction to proceed. Board members Mayor Dempski and Ms. Pietrangelo recused themselves for this application. Attorney S. Gruenberg determined the Board had jurisdiction to proceed with the application. Attorney Gruenberg swore in applicant Michael Hamas of 2 Old Canal Rd. The applicant submitted the following exhibits, A-1 Survey map and A-2 Packet of seven pages supplied by the applicant. Mr. Rossi asked the applicant if there would be grading or retaining walls and the location of the pump. Mr. Hamas stated there would be no major grading and the pump would be located in the shed. The Board briefly discussed the location of the spa and any required landscaping. Attorney Gruenberg asked Mr. Hamas if there was a more conforming location for the pool. Mr. Hamas stated there was no other location because of the location of the septic system and the orientation of the house. Mr. Rossi suggested landscaping for privacy for himself and the neighbors. Vice Chairman Klingel asked if there was any public comment for this application at this time, there was none. A motion was made to grant variance approval with conditions: Landscape plan to be submitted to the satisfaction of the Township Planner S. Doyle, was made by Mr. Sodtalbers, seconded by Mr. Rossi, Mayor Dempski and Ms. Pietrangelo returned to the Board at this time. 3. Blue Mountain LLC - WTPB#2004-20 - Continuation of a Public Hearing for a Minor Subdivision application for Block 24, Lots 6, 6.01 & 6.02. This application has been
continued from the November 10, 2004 meeting and was rescheduled from December 8, 2004 to January 12, 2005. This application has been rescheduled to the January 26, 2005 meeting. Executive Session: 8:05 - 8:15 p.m. A motion to go into Executive Session to discuss “Pending Litigation” was made by Ms. Pietrangelo, seconded by Mayor Dempski, all ayes, motion carried. A motion to come out of Executive Session was made by Ms. Pietrangelo, seconded by Mayor Dempski, all ayes, motion carried.
