JULY 14, 2004

Chairman Artigliere called the meeting to order at 7:30p.m

ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times” December 30, 2003. Notice was posted on the municipal bulletin board in the Township Administration Building in the Washington Township, New Jersey, and notice was filed with the Township clerk on December 30, 2003.

ROLL CALL:

Members Present:Parillo, Klingel, Sodtalbers, Iwaniszyn, Strunk, Rossi, Artigliere

Members Absent: Horensky, Dante, Pflugh

Also Present: Attorney S. Gruenberg, Engineer J. Cilo, Jr. and Planner S. Doyle

COMMUNICATIONS: A List was provided to the Land Use Board members at the meeting.

MINUTES: Minutes from June 30, 2004 will be tabled until July 28, 2004.

DISCUSSION ITEMS:

For Completeness Only:

1. R. Hodge - WTPB#2004-17 - Variance application for Block 78, Lot 12 for a Barbershop. Mr. Hodge was sworn in by Attorney S. Gruenberg. Mr. Hodge stated he was not the owner of the property, John Dorsch was the property owner. Mr. Hodge stated the storefront was currently vacant. The Board requested a current survey, sign location, hours of operation, non use of chemicals and a certification from a professional engineer certifying the existing septic system would be adequate for the proposed use. The applicant must provide checklist “E” for review. Planner S. Doyle stated photos of the property would be helpful and location of all buildings on the property. Attorney S. Gruenberg swore in property owner J. Dorsch.

Mr. Dorsch agreed to provide for the applicant the detail of the location and previous approvals from the Zoning Officer, T. Bocko. The public hearing was scheduled for July 28, 2004.

A motion to deem the application in- complete with additional information requested was made by Mr. Strunk, seconded by Mr. Parillo, Vote: Strunk, Parillo, Klingel, Sodtalbers, Iwaniszyn, Rossi, Artigliere - Ayes, 0 - Nay, 0 - Abstain, motion carried.

2. R. Anema - WTPB#2004-18 - Minor Subdivision application for Block 66, Lot 1.10

Attorney S. Gruenberg swore in Mr. Ralph Anema, Mr. Thomas Grochowicz and Mr. Randy Anema. Mr. Grochowicz stated that he was a friend of the family,  Mr. Ralph Anema would be giving Randy Anema a six acre parcel of land  to build a home on in November

Ms. Doyle reviewed her letter of completeness dated June 21, 2004.  A motion was made to deem the application complete with waivers granted for completeness only by Mr. Sodtalbers, seconded by Mr. Rossi, Vote: Sodtalbers, Rossi, Parillo, Klingel, Iwaniszyn, Strunk, Artigliere - Ayes, 0 - Nay, 0 - Abstain, motion carried. Attorney S. Gruenberg

The application for a minor sub-division will be heard on July 28, 2004.

3. Washington Township Realty Holding Co., Inc. - WTPB#2004-16 - Preliminary Major Site Plan application for “Ocino’s Restaurant Co., Inc.” for Block 64, Lot 13.

Attorney Michael Levine of Pitney Hardin, represented the applicant.

Attorney Levine addressed Ms. Doyle’s completeness letter dated June 21, 2004.

A motion was made to deem the application complete with waivers granted for completeness only by Mr. Parillo, seconded by Mr. Iwaniszyn, Vote: Parillo, Iwaniszyn, Klingel, Sodtalbers, Strunk, Rossi, Artigliere - Ayes, 0 - Nay, 0 - Abstain, motion carried. The public hearing  was opened at this time and rescheduled.  Attorney S. Gruenberg stated no further public notice would be required for this application and the hearing will resume on July 28, 2004.

4. Washington Driving Range - WTPB#2004-13 - Continuation of Public hearing for a  Variance application for Block 66, Lot 20.07, deemed complete June 9 ,2004. Mr. Strunk

stepped down at this time. Attorney Frederick Stem of Stem & Cole represented Mr. Ennis. Attorney S. Gruenberg swore in applicant Troy Ennis. Exhibit A-6 - List of 17 paintball locations in NJ., was submitted. The applicant addressed lighting concerns the Board has.

Planner S. Doyle addressed the location of the playing area, noise, accessory use or structures.  Engineer J. Cilo, Jr. stated the maximum definition of the playing field to be shown to scale for the zoning officer to enforce. Mr. Ennis stated limitations would be shown.

Public Comment:

Mrs. Brown of 105 Rymon Road.

Mrs. Brown asked where the CO2 cylinders would be stored.

Mr. Ennis stated the cylinders would be stored indoors.

The testimony was concluded at this time, the application will be continued until the July 28, 2004 meeting with continued testimony for lighting issues, without further notice being required.

Unfinished Business:

1. Ed Mark 31 - WTPB#2004-12 - Resolution for Site Plan approval for Block 65, Lot 8.03.

Eligible to vote: Dante, Klingel, Pflugh, Sodtalbers, Iwaniszyn. The resolution for this application was tabled until July 28, 2004 meeting.

BREAK: 9:00 - 9:10

2. W. Witkowski - WTPB#2004-15 - Public hearing for a “C” variance application for Block 34, Lot 7. Deemed complete June 9, 2004. Attorney A. Lowcher represented Mr. W. Witkowski.  The following exhibits were presented A-1 Survey Map, A-2 Photos of home, A-3 Photos of surrounding homes, A-4 Letter from adjoining neighbor, block 24 lot 8. Mr. Witkowski was sworn in by Attorney S. Gruenberg. Mr. Witkowski stated his home was built in the 1950's, the garage was on a slab and in poor condition. Mr. Witkowski is proposing the construction of an attached garage and multi purpose room to replace an existing garage. The subject property has an existing septic system located directly behind the house which would prohibit the location of the garage in this area. The existing sideyard setbacks would be encroached upon on either side with the proposed construction. This location has the least impact. Chairman Artigliere asked if there was any public comment at this time, there was none. The public hearing was closed. A motion was made by Mr. Strunk, seconded by Mr. Parillo to grant variance approval, Vote: Strunk, Parillo, Klingel, Sodtalbers, Iwaniszyn, Artigliere - Ayes, 0 - Nay, 0 - Abstain, motion carried.

3. McCullough Road Land Development, LLC - WTPB#2004-14 - Minor Subdivision application for Block 47, Lot 9. Deemed complete on June 30, 2004.

Attorney A. Lowcher requested the application be carried until the July 28, 2004 meeting without further notice being required.

4. M. Mojek - WTPB#2004-10 -  Public hearing for a Preliminary & Final Site Plan application for Block 43, Lot 20. Deemed complete on June 30, 2004.

Attorney S. Ours represented the applicant and reviewed for the Board the applicant’s reason for requesting additional space. Attorney S. Gruenberg swore in the applicant Mr. Mark Mojek. Mr. Mojek stated he was proposing a steel fabricating shop for structural steel and miscellaneous iron for building framework, railings and steps.

Mr. Mojek stated orders for the business would be taken elsewhere and only the fabrication would be performed inside this location. Mr. Mojek stated when the steel is delivered it will be unloaded, cut to size, drilled, welded and shipped. Mr. Mojek anticipated there will be eight employees with the hours of 6:00 a.m. to 6:00 p.m.

Chairman Artigliere asked the applicant if there would be any chemicals at the location.

Mr. Mojek stated all plating would be done off site and priming would be done on site only in a designated area.

PUBLIC COMMENT:

Mr. Edward Terry, 661 Route 57 East.

Mr. Terry stated his concerns for sound, lighting and noise and asked the applicant what assurances would he give them about the processes.

Mr. Mojek stated he would play by the rules, all operations would be performed inside not outside.

Mr. Terry stated he had concerns of additional runoff.

Attorney S. Ours stated that runoff would be addressed by the Engineer’s testimony.

Exhibits A-1 & A-2 were presented showing the building location, railroad, wetlands and berm. Sheet 1 of 3 were driveway openings.

Planner S. Doyle stated the she would like to link landscaping including trees being placed along the roadway and foundation plantings as seen from the road. Ms. Doyle and Attorney S. Ours agreed a revised landscape plan could be worked on with the applicant.

Chairman Artigliere stated outside storage limitations should be clear. Engineer J. Cilo stated a dumpster for scrap metal and recycle should be included on the site plan.

Attorney S. Gruenberg swore in Engineer Timothy Brouse , Mr. Brouse discussed his letter dated July 6, 2004. Engineer J. Cilo and Engineer T. Brouse agreed on the design for the detention basin. The application will be carried until July 28, 2004 for the Board to have a chance to hear testimony from the Township Geotechnical representative.

With no further business before the Board the meeting was adjourned.
