MINUTES JUNE 29, 2005 The meeting will begin at 7:30 p.m. Formal action may be taken at this meeting. No new business will be heard after 11:00 p.m.
Chairman Pflugh called the meeting to order at 7:30 p.m.
ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the Municipal bulletin board in the Township
Administration building in Washington Township, New Jersey, and notice was filed with the Township Clerk on December 22, 2004.
ROLL CALL:
Members Present: Mr. Howell, Mr. Strunk, Mr. Sodtalbers, Mr. Rossi, Mr. Iwaniszyn, Ms. Pflugh, Ms. Pietrangelo, Mr. Birkner, Ms. Belz, Mayor Dempski (7:55)

EXECUTIVE SESSION: 7:35 - 8:05 p.m.
A motion to go into Executive Session to discuss “Pending Litigation” was made by Ms. Pietrangelo, seconded by Mr. Rossi, all ayes motion carried. A motion to return to regular
session was made by Mr. Iwaniszyn, seconded by Mayor Dempski, all ayes motion carried.
CORRESPONDENCE: A correspondence list was submitted to the Land Use Board members.
MINUTES: Minutes from the May 25, 2005 and June 8, 2005 meetings.
A motion to approve the Minutes from May 25, 2005 was made by Ms. Pietrangelo, seconded by Mayor Dempski, Vote: Pietrangelo, Dempski, Howell, Strunk, Sodtalbers, Rossi, Iwaniszyn,
Pflugh, Birkner, Belz, Klingel - Ayes, 0 - Nay, 0 - Abstain, motion carried.
A motion to approve the Minutes from June 8, 2005 was made by Ms. Pietrangelo, seconded by Mayor Dempski, Vote: Pietrangelo, Dempski, Strunk, Sodtalbers, Iwaniszyn, Pflugh, Birkner,
Klingel - Ayes, 0 - Nay, 0 - Abstain, motion carried.
RESOLUTIONS:
1. A. Tambasco - WTPB#2005-17 - Resolution granting Variance approval for Block 81, Lot 7. This application was approved on June 8, 2005.
Eligible to Vote: Dempski, Strunk, Sodtalbers, Klingel, Pflugh, Pietrangelo
A motion to approve was made by Ms. Pietrangelo, seconded by Mayor Dempski,
Vote: Pietrangelo, Dempski, Strunk, Sodtalbers, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried.
2. Hawk Pointe/Asbury Farms - WTPB#2005-18 - Resolution granting Preliminary Site Plan approval for Clubhouse Expansion for Block 65, Lot 2.
Eligible to Vote: Dempski, Strunk, Sodtalbers, Klingel, Iwaniszyn, Pflugh, Pietrangelo, Birkner. A motion to approve was made by Mr. Sodtalbers, seconded by Mr. Iwaniszyn, Vote:

PUBLIC HEARINGS & DISCUSSION ITEMS:
1. Heron Run - WTPB#2005-1 - Continuation of a Public Hearing for a Major Subdivision with Variance relief for Block 82, Lot 17, continued from May 11, 2005.
Eligible to Vote: Dempski, Howell, Strunk, Pflugh, Rossi, Pietrangelo, Iwaniszyn,
Board member Mr. Birkner stepped down for the application.
The applicant was represented by Attorney M. Salvaggi of Corter Kobert and Engineer Mr. George Ritter of Ritter & Plante.
Mr. Salvaggi briefly concluded his review from the last meeting regarding tenant housing.
A motion was made by Mr. Sodtalbers, seconded by Mr. Strunk, to permit a tenant house as an accessory use, Vote: Sodtalbers, Strunk, Dempski, Howell, Rossi, Pflugh, Pietrangelo -
Ayes, 0 - Nay, Iwaniszyn - Abstain, motion carried.
Attorney S. Gruenberg swore in Mr. William Hotz of Hotz Development and Construction,
Far Hills NJ. Attorney S. Gruenberg stated for the record he has previously represented
Mr. Hotz, but not currently. Mr. Hotz briefly reviewed the threshold use issue, work done without permits, his next step would be contacting the zoning officer and speak with the DCA regarding permits. Mr. Ritter reviewed exhibit A-5
Preliminary Subdivision Plan which shows existing structures and no structures within 100 feet of the property line and is conforming to setbacks. Mr. Ritter reviewed exhibit A-6 Plan showing the overall neighborhood, and exhibit A-7 Aerial
View showing existing housing.
Mr. Ritter reviewed the 300 foot buffer for the stream corridor area, the hedgerow and fields. Mr. Ritter stated the application is for 22 single family homes located outside the
critical environmental area. Mr. Ritter stated all lots conform to the steep slope ordinance and are consistent with RSIS standards. Mr. Ritter stated all tree cover would remain untouched. Mr. Ritter stated street lights would be located at
the intersection and fire protection would be located at the entrance and bend of the road. Mr. Ritter reviewed Preliminary Plan Section II
and Planner S. Doyle’s letter dated January 17, 2005. Ms. Doyle requested a sketch be provided to the Board for a bus pad and a possible turnaround.
PUBLIC COMMENT:
Board member Mr. Iwaniszyn asked if the applicant is aware that the property next to the proposed location is a EPA superfund site, Mr. Ritter said yes. Board member Ms. Pietrangelo
suggested a monument or trees as a visual marker for the wetlands buffer.
Engineer J. Cilo stated the planting of trees should be part of a landscaping plan.
Board member Mr. Birkner suggested sycamore trees as a continuation of the tree line dividing subdivision and farm property.
BREAK: 9:45 - 9:55 p.m.
Attorney S. Gruenberg swore in Engineer David Plante of Ritter & Plante Associates.
Mr. Plante reviewed exhibit A-8 showing existing conditions including drainage and exhibit A-2 showing the proposed site plan including carbonate rock on the site.
Mr. Plante gave his review of the stormwater management basins which would include a four foot graded shoulder. Engineer J. Cilo stated he would like to take another look to avoid
the number of basins being proposed. Mr. Strunk asked where does the water infiltrate when the ground is frozen, Mr. Plante stated there would be very little infiltration when the ground is frozen. Mr. Cilo asked what do the limestone experts
say regarding the basins, Mr. Plante stated infiltration basins are common place.
With no further testimony presented the application will resume on July 27, 2005 without further notice being required. Mr. Birkner returned to the Board at this time.
2. Percarpio - WTPB#2004-34 - Continuation of a Public Hearing for a Minor Subdivision application for Block 23, Lot 11, continued from May 25, 2005.
Eligible to Vote: Dempski, Howell, Strunk, Sodtalbers, Klingel, Rossi, Iwaniszyn, Pflugh, Pietrangelo, Birkner, Belz. The applicant was represented by Attorney Bonita Bourke and
Engineer Thomas Bodolosky of Pequest Engineering Company.
The following exhibits were submitted and discussed by Engineer Bodolosky
A-1 Page 2 of plan, A-2 Alternate lot, A-3 Cover sheet for survey, A-4 Conceptual parking,
A-5 Aerial view, A-6 Floor plan. Attorney S. Gruenberg swore in the plant manager of Treitler Owens, Mr. Anz Ranalli. Mr. Ranalli reviewed the office space and stated there are 45
employees currently working at the site which include three shifts. Mr. Ranalli stated there were approximately 20 employees on the day shift and the balance on the 2nd and 3rd shifts. Mr. Bodolsky reviewed and discussed Exhibit A-5 Aerial picture of the proposed parking and Exhibit A-4 showing parking across the creek. Ms. Bourke stated that Lot 11 has additional parking and could sustain itself. Attorney S. Gruenberg suggested the applicant address issues as suggested in the Warren County Planning Department’s letter dated June 28, 2005 and return before the Board.
3. Tenant Housing Ordinance would be discussed at the July 13, 2005 meeting after the Board members had a chance to review it.
