MINUTES Vice Chairman R. Klingel called the meeting to order at 7:30 p.m. ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the municipal bulletin board in the township administration building in Washington Township, New Jersey and notice was filed with the Township clerk. ROLL CALL: Members Present: Mayor Horensky, Mr. Elbassiouny, Mr. Klingel, Mr. Iwaniszyn, Mr. Bundschuh, Mr. Zaret, Mr. Vergos Members Absent: Mr. Howell, Mr. Artigliere, Mr. Rossi, Ms. Pflugh Also Present: Attorney S. Gruenberg, Engineer W. Gleba, Planner S. Doyle CORRESPONDENCE: A list was provided to the land use board members. MINUTES: Minutes from the March 14, 2007 meeting will be submitted at the April 11, 2007 meeting. ITEMS FOR COMPLETENESS: 1. Joe Justo - WTPB#2005-33 - Second completeness review for a Preliminary Major Subdivision application for block 74 lot 5 located at 81 West Asbury Anderson Rd. This application has been re-scheduled to the April 11, 2007 meeting. 2. Unity Bank - WTPB#2007-07 - Completeness review for amended Preliminary Major Site Plan approval for block 78 lot 9 located at 5 East Asbury Anderson Road. The applicant was represented by Attorney A. Lowcher, Engineer J. Symonds. Attorney A. Lowcher briefly reviewed the status of the application for the board. Mr. Lowcher stated there was a title error with the Rt. 31 lot frontage, ingress and egress easement. Mr. Lowcher stated he had no issue with Mr. Gleba’s completeness determination and has filed the additional escrow fees. A motion to deem the application complete was made by Mr. Iwaniszyn, seconded by Mr. Elbassiouny, Vote: Iwaniszyn, Elbassiouny, Horensky, Klingel, Bundschuh, Zaret, Vergos - Ayes, 0 - Nay, 0 - Abstain, motion carried. This application is scheduled for public hearing on April 25, 2007. 3. J. Hackett - WTPB#2004-26 - Completeness review for a Variance application for Block 43 Lot 23 located at 8 Morris Canal Trail. Mayor Horensky and Mr. Elbassiouny stepped down for the application. Applicant J. Hackett represented himself for completeness. Planner S. Doyle reviewed outstanding items from her completeness letter dated January 24, 2007. Applicant J. Hackett addressed the outstanding items for Ms. Doyle. A motion to grant waivers for items 3, 5, & 6H was made by Mr. Iwaniszyn, seconded by Mr. Zaret, Vote: Iwaniszyn, Zaret, Klingel, Bundschuh, Vergos - Ayes, 0 - Nay, 0 - Abstain, motion carried. A motion to deem the application incomplete per Ms. Doyle’s letter dated January 24, 2007 was made by Mr. Bundschuh, seconded by Mr. Vergos, Vote: Bundschuh, Vergos, Klingel, Iwaniszyn, Zaret - Ayes, 0 - Nay, 0 - Abstain, motion carried. Mayor Horensky and Mr. Elbassiouny returned to the board at this time. 4. R. Robinson - WTPB#2007-06 - Completeness review for a “C” Variance application for block 1 lot 3 located at 148 Brass Castle Harmony Road. Mr. Robinson briefly reviewed the application for the board. A motion to deem the application complete was made by Mr. Zaret, seconded by Mr. Vergos, Vote: Zaret, Vergos, Horensky, Elbassiouny, Klingel, Iwaniszyn, Bundschuh - Ayes, 0 - Nay, 0 - Abstain, motion carried. The public hearing date for this application was scheduled for April 25, 2007. DISCUSSION & PUBLIC HEARING ITEMS: 1. M. Kendra - WTPB#2007-01 - Continuation of a Public Hearing for a Variance application for block 40 lot 109 located on Jackson Valley Road. The applicant was represented by Attorney M. Selvaggi and Engineer J. Hansen of Ferriero Engineering. Mr. Hansen briefly reviewed his credentials for the board. Attorney S. Gruenberg swore in Engineer J. Hansen. Mr. Hansen stated the site is located in the highlands preservation area. Access: Mr. Hansen stated the proposed home will be 5500 sq. ft. with a four car garage, Mr. Hansen also stated under a quarter of acre of land would be disturbed for the site. Mr. Hansen briefly reviewed the access drive, wetlands delineation, septic and well. Mr. Vergos stated the driveway was not an acceptable width and there should be major improvements the entire length of the driveway and a turn around should be required. Board Engineer W. Gleba reviewed the ordinance requirements for driveways, a construction plan would be required. Mr. Gleba stated anything over a six percent slope he would recommend paving with a provision for a turn around area. Mr. Hanson stated the driveway ordinance really does not apply to a 2800 ft. driveway and there would of course be an obligation for continued maintenance. Mr. Vergos expressed concerns for emergency and fire vehicles, Mr. Vergos stated he had been to a fire on that road at a previous occasion and the fire truck sunk into the road. Mr. Hansen stated access for emergency vehicles would be a condition of approval. Attorney S. Gruenberg swore in applicant Mr. Mark Kendra. Engineer W. Gleba reviewed his report dated January 26, 2007 and the variances required. Mr. Gleba suggested scaling back the size of the house, Mr. Kendra said he didn’t think it would really change things. Mr. Hansen stated there would be variances required due to the small structures remaining for storage. Mr. Gleba briefly reviewed the stormwater requirements. PUBLIC COMMENT: Attorney M. Selvaggi stated the applicant could secure local approval first prior to going to the highlands for approval. Mr. Hanson stated a DEP exemption will be required. Mr. Sodtalbers suggested the hardship could be eliminated since the wife owns the neighboring lot. Mr. J. Knittel of 134 Jackson Valley Road. Attorney S. Gruenberg stated the applicant would have to return to address outstanding issues at the April 25, 2007 no further notice would be given. BREAK: 9:50 - 10:00 p.m. PUBLIC COMMENT: No public comment offered. EXECUTIVE SESSION: 10:00 - 10:30 p.m. A motion to go into executive session to discuss pending litigation was made by Mr. Vergos, seconded by Mr. Zaret. A motion to return to regular session was made by Mr. Vergos, seconded by Mr. Zaret, all ayes motion carried.
