MINUTES
SEPTEMBER 28, 2005

Formal action may be taken at this meeting.
No new business will be heard after 11:00 p.m.

Vice Chairman Robert Klingel called the meeting to order at 7:40 p.m.

ADEQUATE NOTICE was given as follows: Notice was sent to the “Star Gazette” and “Express Times.” Notice was posted on the Municipal bulletin board in the Township Administration building in Washington Township, New Jersey, and notice was filed with the Township Clerk on December 22, 2004.

ROLL CALL:

Members Present: Mayor Dempski, Mr. Howell, Mr. Sodtalbers, Mr. Klingel, Ms. Pflugh (7:45 p.m.)

Members Absent: Mr. Strunk, Mr. Rossi, Ms. Pietrangelo, Mr. Birkner, Ms. Belz

Also Present: Attorney S. Gruenberg

CORRESPONDENCE: A correspondence list was submitted to the Land Use Board members.

Item #4 - Action is requested for a letter dated September 19, 2005 from Attorney  M. Garofalo. The Board granted Mr. Garofalo permission to proceed with completeness and public hearing if his application is deemed complete on October 12, 2005.

Letter received September 28, 2005 from Attorney A. Lowcher regarding deadlines for Tractor Supply, Action requested. The Board granted Mr. Lowcher permission to proceed with completeness and public hearing if his application is deemed complete on October 12, 2005. Chairwoman K. Pflugh resumed the position as chair.

MINUTES: A motion to approve the minutes from the September 14, 2005 meeting was made by Mr. Sodtalbers, seconded by Mr. Howell, Vote: Sodtalbers, Howell, Klingel, Pflugh - Ayes, 0 - Nay, Dempski - Abstained, motion carried.

RESOLUTIONS:

1.  Trade Zone Auto - WTPB#2004-24 - Resolution for a Major Site Plan application with Variance relief for Block 79, Lot 7.06. This application was denied on March 30, 2005. Eligible to Vote: Belz, Rossi, Howell, Sodtalbers, Iwaniszyn, Pietrangelo, Birkner

A motion to approve the resolution as written was made by Mr. Sodtalbers, seconded by Mr. Howell, Vote: Sodtalbers, Howell - Ayes, 0 - Nay, 0 - Abstained, motion carried.

COMPLETENESS:

1.  Mr. Freeze - WTPB#2005-28 - Completeness review for a Variance application for Block 2, Lot 1, located at 155 Brass Castle Harmony Road.

The applicant was represented by Attorney A. Lowcher. A motion to deem the application complete was made by Mr. Klingel, seconded by Mayor Dempski, Vote: Klingel, Dempski, Howell, Sodtalbers, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried. This application is scheduled for public hearing on October 12, 2005.

2.  Ms. Burdorf - WTPB#2005-30 - Completeness review for a Variance application for Block 48.02, Lot 1, located at 2 Saddlebrook Drive.

The applicant was represented by Attorney A. Lowcher. A motion to deem the application complete was made by Mr. Sodtalbers, seconded by Mr. Klingel, Vote: Sodtalbers, Klingel, Dempski, Howell, Pflugh - Ayes, 0 - Nay, 0 - Abstain, motion carried. This application is scheduled for public hearing on October 26, 2005.

3.  Mr. Hudock - WTPB#2005-29 - Completeness review for a Variance application for Block 31, Lot 8, located at 1 Jackson Parkway. A motion to deem the application complete was made by Mr. Sodtalbers, seconded by Mr. Klingel, Vote: Sodtalbers, Klingel, Dempski, Howell, Pflugh - Ayes, 0 - Nay, 0 - Abstained, motion carried. This application is scheduled for public hearing on October 26, 2005.

PUBLIC HEARING AND DISCUSSION ITEMS: 

1.  Bay Storage - WTPB#2005-11 - Public Hearing for a Major Site Plan application for Block 40, Lot 14.01. This application was deemed complete on August 31, 2005.

The applicant was represented by Attorney L. Fox, Mr. Fox requested an adjournment until October 26, 2005 to address the items in the Engineering review. The applicant will be required to re-notice for a new hearing date of October 26, 2005.

PUBLIC COMMENT:

Mr. Frank Cregan of 62 Merlin Drive.
Was there any new business for Hawk Pointe?

Mayor Dempski stated yes, we have received a copy of an application for modification to Hawk Pointe’s wastewater management plan which is copied to the Township when an application is filed with the DEP.

Ms. Pflugh read a letter from the Highlands Council regarding up coming meetings at the Highland Council headquarters located in Chester, New Jersey.

Tuesday October 18, 2005 - 3:00 - 5:30 p.m.

Wednesday October 19, 2005 - 7:00 - 9:30 p.m.

Thursday October 20, 2005 - 7:00 - 9:30 p.m.

Ms. Pflugh suggested a representative from the Land Use Board attend one of the meetings not the chairperson. Mayor Dempski agreed to make arrangements for someone to represent the Township.

EXECUTIVE SESSION: 8:15 p.m. to 8:25 p.m.

A motion was made by Mr. Klingel, seconded by Mayor Dempski to go into Executive Session to discuss “Pending Litigation”. A motion was made by Mr. Sodtalbers, seconded by Mr. Howell to return to regular session.

ADJOURNMENT: 8:25 p.m.

With no further business before the Board and no public comment offered the meeting was adjourned.
